Acknowledgment of Risks and Assumption of Responsibility
I, the undersigned, understand and acknowledge that participation in physical fitness activities, classes, and use of the equipment at New Fitness Wellness Studio (the "Studio") involves inherent risks, including but not limited to, the risk of injury, illness, or death. These risks may result from my own actions or inactions, the actions or inactions of others, the condition of the facilities, or the equipment used.
Waiver and Release of Liability
In consideration of being allowed to participate in any physical fitness activities and to use the equipment and facilities provided by the Studio, I hereby agree to the following:
- I voluntarily assume all risks associated with my participation in activities at the Studio.
- I waive, release, and forever discharge the Studio, its owners, employees, trainers, instructors, agents, and representatives from any and all claims, demands, actions, or causes of action arising out of or in connection with my participation in activities at the Studio, including but not limited to any injury, illness, or death.
- I agree to indemnify and hold harmless the Studio, its owners, employees, trainers, instructors, agents, and representatives from any and all claims, demands, actions, or causes of action arising out of or in connection with my participation in activities at the Studio, including any injury, illness, or death.
Medical Declaration
I declare that I am physically fit and have no medical condition that would prevent my participation in physical fitness activities at the Studio. I understand that it is my responsibility to consult with a physician before beginning any exercise program. I agree to immediately inform the Studio of any changes in my medical condition that may affect my ability to participate in activities.
Photography and Video Release
I consent to the use of any photographs, videos, or recordings taken of me during my participation in activities at the Studio for promotional and marketing purposes.
Miscellaneous
- This waiver and release shall be governed by and construed in accordance with the laws of the state in which the Studio is located.
- If any provision of this waiver and release is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
Acknowledgment and Understanding
I have read and fully understand this waiver and release form. I am signing it freely and voluntarily and intend my signature to be a complete and unconditional release of all liability to the greatest extent allowed by law.
